By accessing or using Pikyart ("Service", "we", "us", or "our") at www.pikyart.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Pikyart is an AI-powered image transformation platform that allows users to:

• Upload personal images and reference photos
• Transform images using AI to match desired styles
• Generate professional-quality edited images
• Store and manage their image gallery

User Accounts

Account Creation

To use Pikyart, you must:

• Be at least 13 years of age
• Create an account using a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials

Account Responsibility

You are responsible for:

• All activities under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized access

Subscriptions and Credits

Plans and Pricing

We offer three subscription tiers:

• Starter: $5.99/month - 32 images (320 credits)
• Pro: $19.99/month - 120 images (1,200 credits)
• Studio: $39.99/month - 300 images (3,000 credits)

Credit System

• Each image generation costs 10 credits
• Credits are granted monthly upon subscription renewal
• Credits reset each month - unused credits do not roll over
• When upgrading mid-cycle, you receive the new plan's credits immediately
• Credits are non-transferable and non-refundable

Billing

• Subscriptions renew automatically each month
• You will be charged on your renewal date
• Pricing is subject to change with 30 days notice
• All payments are processed securely through Polar.sh and Stripe

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You retain access until the end of your current billing period
• No refunds are provided for partial months
• Your remaining credits are available until the billing period ends

Content Ownership and Rights

Your Content

You retain all ownership rights to:

• Images you upload
• AI-generated images created from your uploads
• Text prompts and descriptions you provide

License to Us

By uploading content, you grant Pikyart a limited, worldwide, non-exclusive license to:

• Process your images through our AI models
• Store your content securely on our servers
• Display your content back to you
• Use anonymized data to improve our Service

Public Content

If you choose to make images public, you grant others the right to view those images. You can revoke public access at any time.

Acceptable Use

You agree NOT to use the Service to:

• Upload content you do not own or have permission to use
• Generate illegal, harmful, or offensive content
• Create deepfakes or misleading content of others without consent
• Upload images containing minors
• Violate intellectual property rights
• Upload malware or malicious code
• Abuse or overload our systems
• Circumvent our security measures
• Use the Service for commercial purposes without permission

Prohibited Content

We strictly prohibit content that is:

• Illegal or promotes illegal activities
• Sexually explicit or pornographic
• Violent, hateful, or discriminatory
• Fraudulent or deceptive
• Infringing on others' rights

Violation of these terms may result in immediate account termination without refund.

Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may modify, suspend, or discontinue features with notice
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions

Intellectual Property

The Pikyart platform, including its design, features, code, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• The accuracy or quality of AI-generated images
• That the Service will meet your specific requirements
• Uninterrupted or error-free operation
• The security of your data (though we implement industry standards)

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKYART SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Any damages exceeding the amount you paid in the last 12 months

Indemnification

You agree to indemnify and hold Pikyart harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or generate

Termination

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Non-payment

Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the applicable jurisdiction.
